BNDES Exim Automático: uma análise à luz da legislação africana

Abstract

O presente artigo sistematiza o resultado da consulta realizada pela Área de Comércio Exterior (AEX) do BNDES a escritórios estrangeiros de advocacia sobre a viabilidade operacional da linha de financiamento BNDES Exim Automático formalizada por meio do desconto de cartas de crédito, à luz da legislação vigente nos países africanos onde estão localizadas as instituições financeiras com melhores perspectivas de parceria operacional com o BNDES, a saber, Angola, Gana, Marrocos, Moçambique, Nigéria e Quênia. A consulta feita aos escritórios estrangeiros analisou aspectos relativos à estrutura documental e operacional que circundam a linha BNDES Exim Automático, municiando a AEX do conhecimento necessário para atuar nos países destacados e possibilitando, ademais, o aprimoramento e a adaptação desse instrumento de apoio às exportações de bens brasileiros às peculiaridades da legislação de cada país estudado.

This article aims to organize and codify the results of a Consulting carried out by the Export Credit Division of BNDES (AEX) to foreign law firms, regarding the operational feasibility of the BNDES Exim Automatic formalized through the discount of letters of credit, given the laws of African countries in which financial institutions offer better perspectives for an operational partnership with the BNDES, namely, Angola, Ghana, Morocco, Mozambique, Nigeria and Kenya. The consulting to the foreign law firms analyzed aspects of the documentation and operational structure formerly conceived to the BNDES Exim Automatic, providing AEX the necessary knowledge to work in the above mentioned countries and enabling, moreover, the improvement and adaptation of this instrument of supporting the exportation of brazilian goods to the peculiarities of the laws of the indicated countries.
