Fundos de investimento como garantidores de contratos de financiamento

Abstract

Aborda-se a concessão de garantias por parte dos fundos de investimento. Em um primeiro momento, faz-se uma análise histórica das instruções da Comissão de Valores Mobiliários que regulam os fundos de investimento em participações e suas alterações. Posteriormente, discorre-se acerca das garantias que poderiam ser concedidas pelos fundos de investimento. Por fim, trata-se da aplicabilidade de restrições que poderiam ser apresentadas pelos financiadores na negociação da concessão de um crédito.

This text addresses the guarantees offered by the investment funds. Initially, it makes a historical analysis of the instructions of Comissão de Valores Mobiliários that regulate the investment funds in shares, and its amendments. Later, it addresses the guarantees that can be offered by investment funds. Finally, it comes to the applicability of restrictions that could be made by lenders in negotiating the loans.
