    <summary type="text">Title: Os comitês de resolução de disputas (dispute boards) nas concessões dos serviços de iluminação pública: análise de cláusulas contratuais a partir das diretrizes de organismos internacionais

Abstract: Development - Banco Nacional de Desenvolvimento Econômico e Social (BNDES) have been modeling concession agreements for public lighting services by including such clauses. Thus, the study aimed to identify whether the clauses modeled by CEF and BNDES comply with the guidelines of these international bodies, and if there are standard clauses from CEF and BNDES that are replicated in these agreements. To address these questions, the contractual clauses of 26 public lighting concession agreements were analyzed: 16 from CEF and 10 from BNDES. It was concluded that there is a similarity between the clauses modeled by the Brazilian structurers. However, there is a need to improve these contracts based on the guidelines and recommendations established by those international bodies, which have not been fully incorporated into the clauses of the agreements studied.

    <summary type="text">Title: Das privatizações à nova estratégia de desenvolvimento: a trajetória do BNDES entre 1990 e 2010

Abstract: The Banco Nacional de Desenvolvimento Econômico e Social (BNDES) is the leading development finance institution in Brazil, and one of the qualified organisms of the Federal Government to implement its economic policy. In recent decades, the BNDES has experienced serious changes that led him first to become the principal executor instrument of privatization policy of the government Collor de Mello Franco and Cardoso. Later, the bank resumed a more developmental role from the Lula government. These changes will be evaluated from the influence of the different development strategies adopted under the role of the bank, and will be analyzed further, the importance of the internal policies of the institution has to influence, as a counterweight, such strategies. What will be shown is that the joint action of internal policies with development strategies promoted by different governments are the main factors of changes in the role of the bank in its historical trajectory and more specifically in the recent time.

    <summary type="text">Title: Governo local, políticas públicas e novas formas de gestão pública no Brasil

Abstract: The present paper consists on the analysis of a set of initiatives promoted by the subnational level of government in Brazil, which are part of the Social Policy System Reform that begun since the 80’s. The analysis is based on a data bank created by the “Gestão Pública e Cidadania” Program (Public Administration and Citizenship), developed by Fundação Getulio Vargas and Fundação Ford, with the support of the BNDES. These initiatives are seen as part of a more comprehensive process of State crisis and are related to the constitutivo of a Reform Agenda, established since the late 70’s. Taking into account this agenda, the paper identifies some trends, which suggest that a gradual chenge is happening in the Social Policies and in the Public Administration in Brazil. These trends point to na increase of the citizenship – through the democratization of the decision making process and through the extension of the access to public services – and to the modernization of public management, as the result of the creative action of the state and local government.

    <summary type="text">Title: A parceria público-privada no contexto da universalização do saneamento no Brasil

Abstract: In the recent years, the sanitation sector has received more attention from the Brazilian government. However, the limited indebtedness capacity of the public sector is preventing meet the goal of 100% attendance of sanitation services in the country. In order to encourage the private sector participation, the model known as Public-Private Partnership – PPP – has been recently launched in Brazil. The first sanitation project was conducted by the National Bank for Economic and Social Development – BNDES – in the city of Rio Claro (SP). In this context, the research aims was to evaluate the first PPP in sanitation and discuss the strategic role of this mechanism in Brazil. Based on the case presented, the main findings suggest that the sustainability of the agents involved should be guaranteed to not allow that private interests prevail over the public, or vice versa.
