    <summary type="text">Title: Financiamento à exportação de serviços de engenharia pelo BNDES: estudo do modelo (1998-2017) e possibilidades de redesenho a partir do Direito Econômico e da Economia Política
Abstract: Over the past ten years, a recurring issue in the Brazilian economic and political debate has been the export credit for engineering goods and services from the Brazilian Development Bank - BNDES. This thesis analyzes this issue using an approach that involves tools from economic law and political economy. The research is based on the observation that there is a gap in academic production and recurring inaccuracies in diagnoses about the flaws, potentialities and possible alternatives for this line of credit. Given this scenario, the following research question is formulated: what legal and economic instruments can be structured so that export credit for engineering services can be redesigned in a way that ensures greater effectiveness and lower risk? Based on this central problem, the investigation unfolds along five axes: (i) the constitutional commands of the economic order and the possibilities for state action in promoting exports; (ii) Brazil's history in export financing and the potential of this policy for economic development; (iii) the design of the Brazilian export financing system, with emphasis on the specificities of the line aimed at engineering services; (iv) the criticisms and diagnoses produced by agencies such as the CGU, TCU and the BNDES CPI; and (v) the possible legal and institutional alternatives to modernize this policy, with greater efficiency and less exposure to risks. The research hypothesis maintains that BNDES financing for the export of engineering and construction goods and services has had significant economic impacts that are compatible with the constitutional precepts of the economic order. However, its continuity requires reformulations that minimize risks, especially after episodes of default, and adapt this public policy to new technological, social and environmental contexts, in such a way as to allow Brazilian companies to once again compete significantly in the international market for large infrastructure projects. The results of the research indicate that the criticisms directed at BNDES, especially in the context of the financing examined in this thesis, have proven to be disproportionate and do not justify the discontinuation of this instrument. The study points out that its interruption was linked, above all, to the political crisis that affected the country in the last decade. Given this scenario, the thesis advocates the formulation of a redesign of this credit line in such a way that a state policy is structured, technically based and institutionally robust, in such a way that it can withstand the oscillations of the political environment and ensure the continuity of strategies essential to long-term national development.

    <summary type="text">Title: Critérios jurídicos de orientação ao credor financiador nas operações DIP financing à luz do art. 69-A da Lei n. 11.101/2005
Abstract: Law No. 14,112, of 2020, promoted some innovations regarding financing for the Debtor, or the Debtor Group, during judicial reorganization, with the introduction of arts. 69-A, et seq., in Law No. 11,101, of 2005, known as the Corporate Reorganization and Bankruptcy Law (LREF), by establishing legal criteria for analysis and guidance to the financing creditor Dip Financing in financing operations for companies under judicial reorganization, in order to promote the restructuring and uplift of the company in crisis. The general objective of the research was to verify what are the legal criteria and parameters to be determined in the structuring of the available guarantees and their developments that allow the raising of funds to the reorganization company with greater legal certainty. Specifically, to bring a practical and professional analysis and approach to financing operations for companies in crisis situations already carried out in the financial market; propose best practices for mitigating future risks; recommend contractual protection mechanisms to the financing creditor; discuss the relevance of financing companies under judicial reorganization as a mechanism to overcome the crisis. In the methodology used, a review of legal literature, research of jurisprudence, laws, collection of journalistic articles and reading of articles related to the theme, exploration and studies of concrete cases based on information collected both in legal proceedings and cited in legal works on the subject were carried out. The concentration and development of the preponderant research project took place in the exploratory model based on studies and analysis of concrete cases of DIP financing carried out in Brazil. The results brought criticism regarding the absence of more legal incentives to the financing creditor in view of the fact that such operations have a high risk associated with the possibility of financial default and the lack of legal uncertainty. In addition, it was possible to assess some weaknesses in its most diverse aspects: encumbrance of guarantees, legal and temporal extra-bankruptcy, financial and legal risks, convertibility of capital into equity, unsecured operations, supervision and inspection mechanisms, among others. There is no intention in this work to exhaust the subject, and its focus is mainly intended for the analysis of DIP Financing operations in the light of article 69-A to article 69-F of the LREF. It is concluded that it will be necessary to mature in the formation of judicial precedents in this regard, which generate significant demands, and it is not possible to state what will be the path to be followed by the national jurisprudence in the interpretation of these intricate legal transactions and the behavior of the financial market in support of this type of operation.

    <summary type="text">Title: Avaliação da proposta de readaptação e otimização dos contratos de concessão de rodovias federais como alternativa para solução de projetos com amplo descumprimento contratual
Abstract: Over the years, the federal highway concession program has brought numerous benefits by improving the quality of highways. However, it has also presented challenges, such as dealing with significant contractual breaches. In such cases, measures have been taken to declare the termination of contracts, often with limited success. Alternatively, the concept of re-bidding was introduced, which so far is considered ineffective in resolving these "stressed" contracts. As a new alternative, the government has proposed the readaptation and optimization of these concession contracts, involving extensive renegotiation with current concessionaires. This study evaluates this new alternative, comparing it with others and concludes that the readaptation and optimization of contracts can represent risks to the concessions program by exceeding the limits of a contractual renegotiation.
